The Constitutional Court in the system of state authorities
Tashkent hosted a round table discussion on “The Constitutional Court in the system of state authorities: tasks and prospects”, organized by the Constitutional Court of the Republic of Uzbekistan and OSCE Project Co-ordinator in Uzbekistan.
Tashkent hosted a round table discussion on “The Constitutional Court in the system of state authorities: tasks and prospects”, organized by the Constitutional Court of the Republic of Uzbekistan and OSCE Project Co-ordinator in Uzbekistan.It was attended by members of the parliament, representatives of courts and law enforcement agencies, ministries and departments, scientific and higher education institutions, as well as civil society institutions.
It was noted that in recent years Uzbekistan has been carrying out systematic reforms aimed at ensuring the rule of law, further reforming the judicial and legal system, protecting human rights and freedoms.
Within the framework of the ongoing reforms, a single Supreme Court has been formed. The Supreme Judicial Council began to operate as a new body of community of judges. All this strengthened the guarantees of protection by courts of the rights of citizens, individuals, legal entities and entrepreneurs.
– There are three models of constitutional justice in the world practice, – says Akmal Saidov, Chairman of the Committee of the Legislative Chamber of the Oliy Majlis. – The second model, that is, the European method, is applied in our country. However, some aspects of applying this model in foreign countries should be implemented in the practice of our country. For example, in European countries there is a concept of “constitutional complaint”. In most countries citizens apply to constitutional courts. I think the right of appealing to the Constitutional Court should be applied in the practice of our country.
Issues of cooperation of the Constitutional Court with legislative and executive bodies of state authority, national human rights institutions and non-governmental non-profit organizations were discussed at the event. Attention was paid to issues of improving protection of human rights through the courts, interaction of the Constitutional Court with the chambers of parliament, the Supreme Court, the Ombudsman.
