In Kazakhstan, issues of privatization of land occupied by buildings and structures are also not sufficiently resolved. Uzbekistan’s intention to put an end to the practice of binding land to buildings left over from the Soviet system is timely, but the development of a legislative and legal basis for mechanisms in this area requires a very careful approach, taking into account all the details, and therefore a long time.
Moderator of the meeting Aziza Umarova, Executive Director of Smartgov Consulting bureau noted that, first of all, it is necessary to conduct a comprehensive inventory of the current legislation related to private property issues. After all, neither the Constitution nor the Land and Civil Codes have anything about this.
Currently, an active process of construction of both business and residential buildings is underway in Uzbekistan. If this ensures a fair mechanism for compensation in demolition of buildings, the population will be ready to change the old housing to a new one. Justice for protecting the rights of owners of land-individuals should be ensured in accordance with the Administrative Procedure Code adopted in Uzbekistan.
