Information on the state of constitutional law in the country considered

A meeting of the Constitutional Court of the Republic of Uzbekistan took place.

The meeting, led by the Chairman of the Constitutional Court M. Abdusalomov, was attended by representatives of the chambers of the Oliy Majlis, the Cabinet of Ministers, the Supreme Court, the Prosecutor General’s Office, the Ministry of Justice, non-governmental non-profit organizations, educational and scientific organizations, as well as members of the Scientific Advisory Council at the Constitutional Court.

In accordance with the Law “On the Constitutional Court of the Republic of Uzbekistan”, information from the Constitutional Court on the state of constitutional law in the country was considered.

It was noted that the renewed Constitution of the Republic of Uzbekistan, adopted in a referendum on April 30, 2023, served as a solid legal basis for further strengthening constitutional law and modernizing state and public life. It was emphasized that the Basic Law aims to democratize government bodies’ activities, creating new constitutional and legal conditions for the reliable provision of human rights and freedoms.

At the meeting, attention was drawn to the fact that the direct application of the Basic Law throughout the country means that it directly regulates public relations and is applied by government bodies and officials, regardless of relevant laws and other regulations.

In 2022-2023, the Constitutional Court studied appeals and law enforcement practice under 119 laws and 1,384 other legal acts.

The Constitutional Court drew attention to the need for the full implementation of the supremacy of the Constitution, ensuring the constitutional rights and freedoms of people through the timely identification and prompt response of competent government bodies to factors affecting the rule of law.

At the meeting, it was noted that non-compliance with constitutional rights should be the focus of attention of the competent government bodies, and each of them should be immediately studied with the necessary measures taken to restore the violated rights.

Along with this, the Constitutional Court noted the need to take, not limited to operational measures, systemic measures to identify and eliminate the causes and conditions that led to non-compliance with constitutional norms.

It was noted that to ensure citizens’ access to constitutional justice and the convenience of using the institution of appeals of citizens and legal entities to the Constitutional Court, it is necessary to take additional measures to provide qualified legal assistance to the population.

The Constitutional Court, having comprehensively studied the issue under discussion and taking into account the opinions of specialists and experts, decided to approve information on the state of constitutional law in the country and send it to the chambers of the Oliy Majlis and the President of the Republic of Uzbekistan.
