Mediation in the legal system of Central Asian Countries
On May 18-20, 2018, Kazakhstan hosted a regional workshop on “Mediation perspectives in the legal system of Central Asian countries”, organized within the framework of the GIZ Program “Promotion of legal statehood in the countries of Central Asia”, in Almaty.
On May 18-20, 2018, Kazakhstan hosted a regional workshop on “Mediation perspectives in the legal system of Central Asian countries”, organized within the framework of the GIZ Program “Promotion of legal statehood in the countries of Central Asia”, in Almaty.Scientists, judges, mediators, lawyers, arbitrators and officials from Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan, Ukraine and Uzbekistan, attended the workshop.
Issues such as alternative dispute resolution in the context of international standard of access to justice, mediation in the system of alternative methods of dispute resolution, its features and principles, models of mediation and its interaction with the judicial system and other legal professions, requirements to mediators, ethical norms of a mediator, procedure for mediation and mediator techniques, conclusion of the mediation agreement and its execution were discussed at the workshop.
Chairman of the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Republic of Uzbekistan Foziljon Otakhonov delivered a speech on “Prospects for the development of mediation in Uzbekistan”.
According to the Press Service of the Chamber of Commerce and Industry of Uzbekistan, during the workshop, the participants got acquainted with the experience of legislative regulation and practice of functioning of the Institute of Mediation in the countries of Central Asia. In particular, representatives of the Republic of Kazakhstan and the Kyrgyz Republic acquainted participants with the peculiarities of laws on mediation, as well as draft laws on mediation of the Republic of Uzbekistan and the Republic of Tajikistan were discussed.
Following the workshop, participants were awarded certificates of attending a course on mediation.
