Current issues in the application of insolvency legislation discussed
On May 6, 2026, the Presidential Decree “On measures to further improve the insolvency framework” was adopted.
The document aims to ensure the sustainable development of entrepreneurial activity, expand pre-trial financial rehabilitation, support economically viable enterprises, introduce a modern, transparent, and digitalized insolvency management system, and enhance the efficiency of public administration.

Under the Decree, the specialization of judges in handling insolvency cases was introduced on June 1, 2026. Cases of this category directly affect the interests of businesses, creditors, employees and the broader business community. In this regard, ensuring consistency in judicial practice is particularly important when considering such cases.

These issues were discussed at a roundtable held at the Supreme Court with the participation of judges specializing in insolvency cases. The event, jointly organized with the Asian Development Bank and the Konrad Adenauer Foundation, brought together representatives of the Supreme Court, regional court judges and international experts.
Participants exchanged views on challenges in judicial practice, specific aspects of applying debtor rehabilitation and liquidation procedures, balancing creditors’ and debtors’ interests, and international best practices and standards.
Experts presented information on effective legal mechanisms used in international practice and the possibilities for integrating them into the national legal system.
The proposals and recommendations developed during the discussions will be consolidated and considered in efforts to improve judicial practice.
