On January 5, 2018, the regular session of the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan was held. Deputies considered a number of draft laws aimed at further deepening reforms that are being held in various spheres of society, protecting the rights, freedoms and legitimate interests of citizens.

Deputies considered a number of draft laws aimed at further deepening reforms that are being held in various spheres of society, protecting the rights, freedoms and legitimate interests of citizens.

On December 22, 2017, the President of the Republic of Uzbekistan Shavkat Mirziyoyev, in his Address to the Oliy Majlis emphasized that the parliament is called upon to develop effective laws aimed at radical improvement of various spheres. In this regard, during the discussion of draft laws, deputies paid particular attention to the practical implementation of tasks identified by the Head of our state.

The meeting began with consideration in the first reading of the draft law “On Mediation”, developed for creating legal conditions for development of alternative ways of settling disputes in the country with participation of independent persons – mediators, reducing the burden on the courts.

Deputies noted that implementation of mediation in resolving disputes would save time and reduce the litigation costs of disputing parties – citizens, organizations, including business entities. They will become able to quickly and cheaply, in a convenient place and time, resolve the dispute that has arisen between them on mutually beneficial terms privately, without bringing it to court, without involving lawyers, without paying the state fee and the costs associated with the litigation. Thus, the parties will have the opportunity to quickly resolve the dispute.

At the same time, it was emphasized that the adoption of the Law “On Mediation” will ensure the systematic and comprehensive legal regulation of relations arising in the sphere of pre-trial dispute settlement, create effective organizational and legal mechanisms for implementation of pre-trial settlement of disputes.

Then deputies discussed the draft law “On Public Procurement”.

Deputies emphasized the importance of adopting laws of direct action in accordance with tasks indicated by the Head of the state. In this regard, the draft law is of great importance.

In addition, the study of international experience of particular countries of the world showed that the most effective public procurement systems are in countries such as the United States, Chile, the Russian Federation, Belarus and Kazakhstan, in which the entire procurement process is regulated by a single document – the Law.

As noted at the meeting, the draft law was developed in order to regulate legal relations in the sphere of public procurement, as well as eliminating existing in practice contradictions and obsolete standards. Deputies emphasized that the adoption of the law will increase the openness and transparency of public procurement system. In particular, the draft law envisages the opening of a special information portal of public procurement.

Thus, a clear system of public procurement will be established in the country, which ensures the most effective and rational use of budgetary and other financial resources. These measures, in turn, will help to strengthen healthy competition and exclude cases of corruption in this area.

Then deputies considered the draft law “On ratification of the Agreement between the Republic of Uzbekistan, the Republic of Kazakhstan and Turkmenistan on the junction point of the State borders of the three states (Samarkand, November 10, 2017)”.

The Agreement specifies the location of the junction point of the state borders of Uzbekistan, Kazakhstan and Turkmenistan and the passage of state border lines near the junction point, as well as a corresponding description was made.

Decisions were taken on the approval of the discussed draft laws and preparation for consideration in the second reading.

At the meeting, other issues related to the powers of the Legislative Chamber of the Oliy Majlis were also considered.
